By purchasing services, paying a deposit, scheduling training, submitting payment information, or otherwise engaging services with Undercover Alpha K9 Services, LLC ("UAK9"), Client acknowledges that they have read, understood, and agree to be bound by these Terms of Service.
Electronic acceptance of these Terms shall have the same force and effect as a handwritten signature.
Deposits are applied toward the total cost of services and reserve training availability.
Unless otherwise stated in writing by Undercover Alpha K9 Services, LLC, all deposits are non-refundable.
Payment of a deposit constitutes acceptance of these Terms of Service.
Dog training is not an exact science. Results vary based on numerous factors including, but not limited to, the Dog's temperament, genetics, environment, health, consistency of training, household compliance, and Client participation.
Undercover Alpha K9 Services, LLC makes no guarantee regarding specific behavioral outcomes, timelines, performance standards, or training results.
While the Trainer will make every reasonable effort to assist the Client in achieving their Dog's training and behavior goals, no guarantee is made regarding the Dog's long-term behavior or performance as a result of professional training.
Private training sessions, coaching sessions, lesson packages, and other prepaid training services are intended to be completed within the timeframe recommended by the Trainer.
Any unused sessions remaining twelve (12) months after the original purchase date may be forfeited at the sole discretion of Undercover Alpha K9 Services, LLC.
Approved extensions may be granted in writing at the sole discretion of Undercover Alpha K9 Services, LLC.
Clients must be at least eighteen (18) years of age to purchase services, enter into an agreement, or participate in training services without the consent of a parent or legal guardian.
Services conducted outside Undercover Alpha K9 Services, LLC's standard service area may be subject to additional travel fees.
Travel fees will be disclosed prior to scheduling whenever possible.
For immersive training services, there is a $60 surcharge for pick-up and drop-off services outside of a 20-mile radius of Trainer location and up to 30 miles. Travel beyond 30 miles is subject to a mileage charge of $2.00 per mile, one way.
This document describes the Agreement and includes all contractual obligations made between Undercover Alpha K9 Services, LLC, hereinafter referred to as "UAK9," "Company," "Trainer," "We," "Our," or "Us," and the Client, hereinafter referred to as "Client," "Owner," "You," or "Your."
The Client wishes to engage the Company as a contractor to perform the services described herein.
The purpose of this Agreement is to establish a clear understanding of the objectives, responsibilities, and expectations related to the training services provided by Undercover Alpha K9.
The primary purpose of this Agreement is to facilitate effective and safe dog training, addressing specific behavioral issues, enhancing obedience, improving the overall relationship and welfare between the Client and their Dog, fostering breed fulfillment, harmonious living, and mutual respect and understanding.
The Trainer aims to utilize their expertise and experience in dog training to educate both the Client and their Dog, fostering a positive and cooperative training environment.
The Trainer agrees to provide dog training services within the agreed upon timeframe of the chosen program.
While the Trainer will make every reasonable effort to assist the Client in achieving their Dog's training and behavior goals, no guarantee is made regarding the Dog's long-term behavior or performance as a result of professional training.
The Client understands that maintaining the Dog's progress is dependent upon their consistent reinforcement of the training, the Dog's temperament, and other contributing factors.
By participating in training with UAK9, Client understands and agrees that their Dog may be trained using balanced training tools, methods, and techniques, which may include but are not limited to crates, slip leashes, e-collars, prong collars, food, bark collars, toys, and other tools deemed appropriate for the Dog's welfare and training needs.
Trainer agrees to provide training services and instruct Clients on how to work with their Dogs effectively, including but not limited to methods such as positive reinforcement training, clear signals training, escape/avoidance training, and balanced approaches based on the needs of the Dog.
Trainer agrees to:
a. Conduct a thorough behavioral assessment of the Dog.
b. Develop and provide a tailored training plan specific to the Dog's behavioral challenges, needs, and goals with projected outcomes.
c. Communicate clearly with the Client about the Dog's progress and provide resources.
d. Utilize expertise to effectively assist the Client's Dog in achieving training goals.
e. Offer guidance and support throughout the chosen program and following program completion.
f. Properly care for the Dog during immersive training services.
The Client agrees to:
• Materially follow the Trainer's instructions as provided.
• Practice training methods daily as recommended.
• Ensure consistency among household members and handlers.
• Maintain structure, boundaries, supervision, and environmental management.
• Manage the Dog responsibly and safely at all times.
• Keep the Trainer informed of any medical conditions, injuries, medications, or behavioral progressions and regressions.
• Refrain from using conflicting, abusive, aversive, or inconsistent training methods.
• Ensure all recommended training equipment is present and functional.
• Provide regular food, medications, and written instructions during immersive training services.
Failure to comply with these responsibilities may negatively affect training outcomes and may result in limited progress, additional fees, suspension of services, termination of services without refund, and/or voiding of any applicable guarantees.
Weekly Training Commitment
• Sessions are to be scheduled and conducted in accordance with the recommended frequency for the duration of the program.
• Client is responsible for tracking assigned homework and reporting progress prior to sessions.
Cancellations & Rescheduling
• Clients are allowed no more than two (2) cancellations for the duration of the program.
• Exceeding this limit may result in removal from the program without refund.
• A minimum of forty-eight (48) hours notice is required to cancel or reschedule any session.
Late Cancellations & No-Shows
• Cancellations made with less than forty-eight (48) hours notice or failure to attend a scheduled session without notice may result in forfeiture of that session.
• Excessive rescheduling may be considered grounds for removal from the program.
Virtual Coaching Expectations
• All training-related questions will be addressed during scheduled coaching sessions.
• Clients are allowed no more than two (2) cancellations of virtual coaching sessions during the program.
Communication Expectations
• Communication regarding scheduling, training progress, concerns, and questions must occur through approved communication channels.
• Both Trainer and Client are expected to respond within a reasonable timeframe, generally within twenty-four (24) hours.
Homework Requirement
Training outcomes cannot be guaranteed and are dependent upon the Client's commitment to implementing the Dog's training plan, completing assigned homework, and consistently applying the techniques taught by Undercover Alpha K9.
Limited participation or failure to complete homework may delay or reduce the Dog's progress or disqualify the Client from scheduling future sessions.
Termination
Either Party may terminate services by providing written notice.
Refunds will not be provided for completed sessions.
Requests for refunds on unused sessions must be submitted in writing and remain subject to Company discretion.
Termination does not relieve the Client of payment obligations.
Program Reservation and Non-Refundable Payments
Immersive training programs require reservation of dedicated time, space, and resources exclusively for the Client's Dog.
All payments made toward immersive training programs, including deposits and program fees, are non-refundable under any circumstances, including cancellation, delayed start, early termination, or failure to complete the program.
No refunds, credits, or prorated reimbursements will be issued except under extenuating circumstances and solely at Company discretion.
Delayed Start and Rescheduling
Requests to delay or reschedule immersive training must be submitted in writing and are subject to Trainer approval.
Requests made within seven (7) days of the scheduled start date may be denied and may result in forfeiture of the original training slot and/or a rescheduling fee of up to $150.00.
Force Return or Removal from Training
UAK9 reserves the right to require immediate removal or return of the Dog if the Dog poses a safety risk to itself, other animals, or any person, or if the Dog's behavior exceeds the scope of services agreed upon.
The Client agrees to retrieve the Dog within twenty-four (24) hours of notice.
No refunds shall be issued in the event of early termination under this section.
UAK9 shall charge the Client a fee for services provided.
Payment is due upon commencement of services unless otherwise agreed in writing.
Failure to pay shall constitute a breach of this Agreement.
UAK9 shall assess a late fee equal to ten percent (10%) of the total program cost for every thirty (30) calendar days the account remains unpaid.
Accounts remaining unpaid for three (3) months may be forwarded to collections.
Accepted forms of payment include ACH transfer, VISA, Discover, Amex, check, or cash. Mastercard is not accepted.
For immersive training services, unpaid balances shall accrue interest at one and one-half percent (1.5%) per month, or the maximum amount permitted by law, whichever is less.
You authorize UAK9 to transport your Dog as needed for training purposes or emergencies.
This may include transportation to and from your residence, training locations, recreational areas, veterinary facilities, or the Trainer's residence.
For immersive training services, all Dogs are transported in a secured manner and monitored during transport.
The service fee covers only the proprietary training provided by UAK9.
Additional expenses including veterinary visits, medications, medical treatment, vaccinations, food, treats, training materials, and related expenses are the sole responsibility of the Client.
The Trainer will make reasonable efforts to obtain Client authorization before seeking emergency veterinary care.
In life-threatening emergencies, the Client authorizes the Trainer to seek emergency veterinary treatment.
The Client agrees to reimburse veterinary expenses incurred on behalf of the Dog up to $15,000.00 unless additional authorization is obtained.
The Trainer may require veterinarian clearance prior to training.
The Dog must be medically suitable for training participation.
The Dog must be current on required vaccinations and flea and tick prevention.
For immersive training services, required vaccinations include Rabies, Bordetella, DAPP, Lepto, CIV, and a negative fecal examination completed within the previous 365 days.
The Client represents that all known aggression, bite history, and dangerous behaviors have been disclosed.
The Client acknowledges that Dogs may behave unpredictably.
The Client assumes responsibility for injuries or damages caused by their Dog and agrees to indemnify and hold harmless UAK9 except in cases of gross negligence or willful misconduct.
The Client acknowledges the inherent risks associated with dog ownership, handling, boarding, transportation, and training.
The Client agrees to indemnify and hold harmless UAK9, its owners, employees, contractors, and representatives from claims arising from the behavior or actions of the Client's Dog except in cases of gross negligence or willful misconduct.
The Trainer agrees to exercise reasonable care in handling, supervision, transportation, and training of the Dog.
To the fullest extent permitted by law, the total liability of UAK9 shall not exceed the total amount paid by the Client under this Agreement.
UAK9 shall not be liable for indirect, incidental, consequential, special, or punitive damages.
The Client acknowledges that aversive training tools including e-collars, prong collars, bark collars, dominant dog collars, and other corrective devices may be utilized in training.
The Trainer will provide instruction on proper use and humane application.
The Client agrees to use these tools only as instructed.
Client grants UAK9 permission to photograph, record, and use images, videos, audio recordings, testimonials, and other media depicting the Client and/or the Client's Dog for marketing, educational, promotional, and business purposes.
All media created by UAK9 remains the sole property of the Company.
Client may opt out of public use by providing written notice.
This Agreement serves as a perpetual release and authorization for such use.
Both Parties acknowledge the confidential nature of information exchanged during services.
Both Parties agree to keep confidential information private except as required by law or court order.
The Parties agree to resolve disputes through confidential binding arbitration in Los Angeles County, California.
Arbitration shall be administered by Judicial Arbitration and Mediation Services (JAMS) pursuant to the Expedited Procedures of the Comprehensive Arbitration Rules.
Each Party shall bear its own arbitration costs.
This Agreement shall be governed by the laws of the State of California.
The Parties consent to the exclusive jurisdiction of Los Angeles County, California.
This Agreement may only be amended in writing.
This Agreement constitutes the entire understanding between the Parties and supersedes all prior discussions, negotiations, and agreements.
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement shall be binding upon and inure to the benefit of the Parties and their successors and assigns.
This Agreement may be executed in counterparts and transmitted electronically.
The Trainer shall not be responsible for failure to perform services due to causes beyond reasonable control including acts of God, civil authorities, military authorities, riots, embargoes, natural disasters, or other unforeseen circumstances.
The Trainer shall make reasonable efforts to resume performance following such events.
